This page contains the Terms of Use governing your access to and use of the www.chefsbk.co.uk, www.chefsbk.com and their related sub-sites and all other “chefsbk” denominated sites owned by MyEChef Ltd.(the “Website” or “Site”).

If you do not accept these Terms of Use or you do not meet or comply with their provisions, you may not use the Website.

MyEChef Ltd makes every effort to maintain the accuracy of the content provided, however the content is provided for illustrative purposes only and your business use is at your own risk.

TERMS APPLICABLE TO ALL USERS

Unregistered users are prohibited from access the site or it’s content.

For subscribed users who control and pay for one of our sub-sites additional terms are recorded below for your attention and also held on your sub-site. These are in addition to these TOU shown here.

Owner: refers to MyEChef Ltd, which owns all and any web domains and websites with a “chefsbk” denomination, and all authorised websites, sub-domains and allocated domains designated with the inclusion of ” chefsbk ” for subscription, rental and use by its members.

Members: are persons, firms or businesses, which have an agreement with MyEChef Ltd to purchase a subscription to a “chefsbk” denominated site to rent the use of one of MyEChef Ltd’s domains for use in their organisation or personally.

Invitees: any person who has beeninvited to use the content of a site, even though they may not be the primary user of that site. For example these may be employees or colleagues within a business.

Suppliers: are persons, firms or businesses that pay to have their branding and products featured on the MyEChef Ltd’s websites.

2. Changes to Terms

MyEChef Ltd may, at any time, for any reason and without notice, make changes to (i) this Website, including its look, feel, format, and content, as well as (ii) the products and/or services as described in this Website and (iii) its other defined domains containing the ” chefsbk ” domain names.

Any modifications will take effect when posted to the relevant Website. Therefore, each time you access the Website, you need to review all Terms of Use upon which access and use to this Website and authorised ” chefsbk ” domains is conditioned.

5. Allergen Information

MyEChef Ltd regularly checks that allergen information attached to ingredients presented in its illustrative recipes is accurate.

However, MyEChef Ltd specifically disclaims any responsibility for the accuracy of allergen information provided if a recipe is copied within a users business as it is the responsibility of that business’ owner and its staff to ensure they have been trained and understand allergens and their potential impact on their customers.

Support documentation is available through the Food Standards Agency and other online training is available to access.

Business owners must be aware that prepared ingredients, although apparently similar, can vary in constituent ingredients and this can consequently mean allergens can be different or change from time to time.

Consequently, it is incumbent upon business owners and their teams to make themselves fully conversant with allergens in any ingredient they use and have an effective recording, review and updating system, using their “chefsbk” platform to record these updates, for these so that customers can be confidently advised when allergen information is requested.

6. Nutrition Information

MyEChef has provided nutritional calculations functionality as part of its illustrative recipes.

However, MyEChef Ltd specifically disclaims any responsibility for the accuracy of nutrition information.

It is provided for illustrative purposes only and should never be relied upon as 100% accurate or used for health, medical or dietary purposes.

If calculations in these respects are required, businesses should refer to a qualified nutritionist.

Due to the complexity of nutrition and the actual broad variance and error margins in the data available further explanatory notes are available in this sites information centre.

7. Scope of Use and User E-Mail

As a paying member you are authorised to view, use, copy for your records and download portions of the content for use in your own “chefsbk” denominated site (including without limitation text, graphics, audio and video files and photos) of this Website for your own site provided that you leave all the copyright notices, including copyright management information, or other proprietary notices intact.

The commercial use, reproduction, transmission or distribution of our softwareis strictly prohibited.

These terms confirm that registered users may use developed recipe content for use in their own business where serving paying customers, but recipes are prohibited form being used in any other commercial environment such as websites, cookery books and other media that benefits the user financially unless express permission is sought in writing from MyEChef Ltd before use.

8. Copyrights and Trademarks

The materials on Sites owned by MyEChef Ltd, as well as the organisation and layout of this site, are copyrighted and are protected by United Kingdom and international copyright laws and treaty provisions.

You may access, download and print materials on this Website only if your are a registered and fully paid up member to the site in accord with the terms of use described below in the additional membership terms and conditions (section B) and solely for use within the prescribed and identified site(s); however, any print out of this Site, or portions of the Site, must include MyEChef Ltd ’s copyright notice.

No right, title or interest in any of the materials contained on this Site is transferred to you as a result of accessing, downloading or printing such materials. All users agree that the Owner reserves the right to allow Network Directory Suppliers to advertise or sponsor specific content of any of the “chefsbk” domains and the members and subscribers acknowledge that the same proprietary rights are applicable to the Supplier Advertiser trade names and associated branding mediums are protected under copyright, trademark and other intellectual property laws and such contents may not be reproduced without the consent of Owner.

Subscribers, members and suppliers retain all right, title and interest including copyright and other proprietary or intellectual property rights of their own trade names, trademarks and service marks therein.

16. U.K. Resident & Confirmation of Age

You represent that you are a United Kingdom resident and are over the age of 16 years of age.

17. Users Disputes

You are solely responsible for your interactions with other Users. MyEChef Ltd reserves the right, but has no obligation, to monitor disputes between you and other Users, including your direct use of our site sponsors services.

18. Arbitration

Except as regarding any action seeking equitable relief, including without limitation for the purpose of protecting any MyEChef Ltd confidential information and/or intellectual property rights, any controversy or claim arising out of or relating to these Terms of Use or our Websites shall be settled by binding arbitration in accordance with the provisions, in effect at the time the proceedings begin, of the Arbitration Act 1996.

Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be held in London.

All information relating to, or disclosed by any party, in connection with the arbitration of any disputes hereunder shall be treated by the parties, their representatives, and the arbitrator as proprietary business information. Such information shall not be disclosed by any party or their respective representatives without the prior written authorisation of the party furnishing such information. Such information shall not be disclosed by the arbitrator without the prior written authorisation of all parties.

Each party shall bear the burden of its own counsel fees incurred in connection with any arbitration proceedings.

Judgment upon the award returned by the arbitrator may be entered in any court having jurisdiction over the parties or their assets or application of enforcement, as the case may be.

Any award by the arbitrator shall be the sole and exclusive remedy of the parties. The parties hereby waive all rights to judicial review of the arbitrator’s decision and any award contained therein.

19. Indemnity

As a user you agree to defend, indemnify, and hold MyEChef Ltd, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

20. Accounts And Security

MyEChef Ltd does not warrant that the functions contained in the service provided by the Website will be uninterrupted or error-free, that defects will be corrected or that this service or the server that makes it available will be free of viruses or other harmful components.

As part of the registration process, MyEChef Ltd will set up a username for your account. A password will be generated upon activation of the account for you.

You shall provide MyEChef Ltd with accurate, complete, and updated account information. Failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your Account.

You may not:

(a)   select or use a Login Name of another person with the intent to impersonate that person;

(b)  use a name subject to the rights of any other person without authorisation;

(c)   use a Login Name that the Website, in its sole discretion, deems inappropriate or offensive.

(d) share your log in and password details with anyone else providing them with unauthorised access to “chefsinbusiness” sites

You shall notify MyEChef Ltd of any known or suspected unauthorised use(s) of your Account, or any known or suspected breach of security, including loss, theft, or unauthorised disclosure of your password.  You shall be responsible for maintaining the confidentiality of your password.

Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your Account, at MyEChef Ltd’s sole discretion, and you may be reported to appropriate law-enforcement agencies.

21. Force Majeure

The Owner will not be responsible for any failure or delay in performance hereunder that is directly or indirectly related to acts of God, storm, natural disaster, act of terrorism, utility outages or interruptions, system transmission failure, telecommunications or electrical failures, server failure, strike, lock out, delays, loss or damage to items in transit, embargoes or government regulations and restrictions or any other situation which is beyond its control.
